About these Terms

These Terms of Use (“Terms”) apply to the HoppyTime website and mobile apps (together, “HoppyTime”). HoppyTime is operated by HIPPY (C.Y) International Ltd (“HIPPY,” “we,” “us” or “our”), 29 Hamachteret St., Ramat Hasharon, Israel.

By creating an account or using HoppyTime, you agree to these Terms and confirm that you have read our Privacy Policy and Children’s Privacy Notice (“Privacy Policy”). The Privacy Policy explains what information we collect and how we use it, and it forms part of these Terms. If you do not agree, please do not use HoppyTime.

Who may use HoppyTime

• HoppyTime accounts are for parents and legal guardians who are at least 18 years old.
• Children may use HoppyTime only through a parent’s account, with the parent’s permission and participation. HoppyTime is designed to be played together, not by a child alone.
• You are responsible for keeping your sign-in details secure and for activity on your account.
• Please give us accurate information when you register.

The HoppyTime pilot

HoppyTime is currently offered as a pilot, including through participating organizations and pre-release versions of the apps. During the pilot:

• HoppyTime is provided free of charge to participating families.
• Features and content may change, be limited, be unavailable at times or contain errors.
• We may invite you to share feedback or take part in optional surveys or interviews. Participation is voluntary.
• We may end or pause the pilot, or any part of HoppyTime, at any time. We will try to let you know in advance where reasonably possible.

AI-generated content

HoppyTime uses artificial intelligence to hold conversations, narrate stories and create illustrations. AI can make mistakes. Responses or images may sometimes be inaccurate, incomplete or unexpected.

• HoppyTime is an educational play experience. It is not medical, psychological, developmental or professional advice, and it does not assess or diagnose a child.
• A parent should be present during activities and use their own judgment. If something seems inappropriate, stop the activity and let us know.
• Please do not share unnecessary personal information, such as addresses, school names or health details, during activities.

Using HoppyTime responsibly

You agree not to:

• Use HoppyTime for any unlawful, harmful or abusive purpose, or try to make the AI produce inappropriate content.
• Copy, sell, resell or commercially exploit HoppyTime or its content.
• Reverse engineer, disrupt, overload or try to gain unauthorized access to HoppyTime or its systems.
• Share your account with people outside your household.

Ownership

HoppyTime, including its activities, stories, characters, curriculum, design, software and the HoppyTime and HIPPY names and logos, belongs to HIPPY or its licensors and is protected by intellectual property laws. We give you a personal, non-exclusive, non-transferable and revocable permission to use HoppyTime for your family’s own non-commercial use, in line with these Terms.

You may keep and enjoy illustrations and other content created for your family during activities for personal, non-commercial use. If you send us feedback or ideas, we may use them to improve HoppyTime without any obligation to you.

App stores

If you download HoppyTime from the Apple App Store or Google Play, your use of the app is also subject to the terms of that store.

For apps obtained from Apple

• These Terms are between you and HIPPY only, not Apple. HIPPY, not Apple, is responsible for the app and its content, maintenance and support.
• Apple has no obligation to provide maintenance or support for the app and, to the maximum extent permitted by law, has no warranty obligation for it.
• HIPPY, not Apple, is responsible for handling any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

For apps obtained from Google Play

• These Terms are between you and HIPPY only, not Google. HIPPY, not Google, is responsible for the app, its content and support.
• Your use of Google Play itself is governed by Google’s own terms of service.

Disclaimers

HoppyTime is provided “as is” and “as available.” To the fullest extent permitted by law, we do not promise that HoppyTime will always be available, uninterrupted, error-free or suitable for every child or family, or that it will achieve any particular learning result.

Limitation of liability

To the fullest extent permitted by law, HIPPY will not be liable for any indirect, incidental, special or consequential damages, or for loss of data, arising from your use of HoppyTime. Because HoppyTime is provided free of charge during the pilot, our total liability to you for any claim relating to HoppyTime will not exceed US$100. Nothing in these Terms limits any rights you have that cannot be limited under applicable law.

Ending your use

You may stop using HoppyTime and delete your account at any time through Settings, as described in the Privacy Policy. We may suspend or close an account if these Terms are breached or if needed to protect children, families, HIPPY or others.

Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date and, for important changes, notify parents through the app or by email. Continuing to use HoppyTime after changes take effect means you accept the updated Terms. Changes to how we handle children’s personal information are governed by the Privacy Policy, including any renewed parental consent it requires.

Governing law

These Terms are governed by the laws of the State of Israel. You may bring any claim relating to HoppyTime either in the competent courts of Tel Aviv-Jaffa or in the courts of the place where you live. Nothing in these Terms takes away any protection you have under the consumer laws of your country or state of residence.
